This page is a plain-language summary of the agreement between you and the operator of Seoulvivor, written so it can actually be read — it is not legal advice.

The short version / 요약

Seoulvivor is a practice game. An AI plays a Korean character, listens to you, and gives you a grade. The AI gets things wrong, the grade is an estimate, and none of it is an official assessment of anything. Purchases go through Apple, so Apple handles cancellations and refunds. By downloading or using the app, you accept everything below.

본 약관은 서울바이벌(Seoulvivor) 이용에 관한 계약입니다. 앱을 내려받거나 이용하는 것으로 아래 내용에 동의하게 됩니다. 영문본과 국문 표제의 해석이 다를 경우 영문본이 우선합니다.

  1. Who this agreement is with / 계약 당사자

    This is an agreement between you and the operator of Seoulvivor ("we", "us", "the operator") — identified in clause 18. It covers the Seoulvivor iOS application and everything it connects to: our servers, your account, and this website.

    You accept it by downloading, installing, or using the app. If you do not accept it, do not use the app — delete it.

    You must be old enough to enter a binding contract where you live. If you are under the age of majority in your country, a parent or guardian must read and accept these terms on your behalf and is responsible for your use of the app.

  2. What Seoulvivor is / 서비스의 내용

    Seoulvivor is a spoken Korean-language roleplay trainer. A large language model plays a Korean character in a scripted situation, transcribes what you say out loud, and grades your listening, your speaking, and your nunchi — how well you read the social situation — into a single grade from S down to F.

    At the time of writing the app contains 126 scenarios, the first of them a tutorial, with new scenarios added on an ongoing basis. Content, scenario counts, and features change over time; clause 12 explains what we may add, alter, or withdraw.

    It is a game. It is not a course, not a tutor, not a certification body, and not a substitute for a qualified teacher.

  3. Your licence to use the app / 이용 허락의 범위

    We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the app on Apple devices that you own or control, for your own personal, non-commercial language practice. That is the whole of what you are granted. Everything not expressly granted is reserved.

    You must not:

    • copy, modify, translate, or make derivative works of the app;
    • reverse engineer, decompile, or disassemble the app, or try to derive its source code, its prompts, its system instructions, or its grading logic — except, and only to the extent, that applicable law expressly permits this despite this restriction;
    • scrape, harvest, or bulk-extract scenario text, character dialogue, audio, or any other content from the app or our servers;
    • access the service by any automated means — bot, script, scraper, emulator, or modified client — or through any interface other than the app as we publish it;
    • resell, rent, lease, sublicense, or otherwise make your access available to anyone else, including sharing an account or selling quest keys or unlocked scenarios;
    • remove, obscure, or alter any proprietary notice or attribution; or
    • use the app, its outputs, or its content to build a competing product or to train a machine learning model.
  4. What the AI produces, and what not to rely on it for / AI 결과물에 대한 면책

    The Korean character, the dialogue it speaks, the transcription of your speech, and every grade and comment you receive are generated by a large language model. Models of this kind are wrong sometimes, and there is no version of this app in which they are not.

    Specifically, and without any of this being a defect:

    • the Korean you are shown may be unnatural, incorrect, or wrong for the situation;
    • the transcript may not be what you actually said;
    • a grade may reward a poor answer or punish a good one; and
    • the same performance may be graded differently on different days.

    Do not rely on anything the app produces when making a real-world decision. That includes, in particular, anything touching visas, immigration, or residency status; legal rights or obligations; medical or health matters; employment; or money. The scenarios are fiction written for practice. They are not advice, they do not describe how any real office, official, landlord, employer, or clinician will behave, and no grade tells you whether you are ready for a real conversation.

  5. The score card is not a TOPIK result / TOPIK 무관 고지

    The app presents your result on a card styled after a Korean proficiency certificate. That styling is a game artefact — part of the app's fiction — and nothing more.

    Seoulvivor is not affiliated with, endorsed by, sponsored by, licensed by, or connected in any way to the Test of Proficiency in Korean (TOPIK), the National Institute for International Education, any ministry or agency of the Republic of Korea, or any other government body, examining authority, or accrediting organisation.

    A grade from Seoulvivor is an estimate of how a conversation went inside a game. It is not a TOPIK score, it is not equivalent to one, it confers no qualification, and it has no official standing with anyone, anywhere. Do not present it as one. Trade marks referred to on this page belong to their respective owners and are named only to make this non-affiliation clear.

  6. Plays, subscription, and quest keys / 이용 횟수·구독·퀘스트 키

    Free account 3 The count resets at the start of each new day in Korea Standard Time (UTC+9), wherever you are.
    Premium subscription 10 Auto-renewing, sold through Apple. Same Korea-time reset.
    Quest key A one-off consumable that permanently unlocks one premium scenario on your account. It is not a subscription and does not raise your daily play limit.

    Entitlement is decided by our server, not by your device. Subscription state is reconciled with Apple through RevenueCat, and our server's record is the authority. If your device and our server disagree about what you are entitled to, the server's record governs.

    Daily plays are a usage allowance, not a stored item. Unused plays do not roll over, do not accumulate, and have no cash value.

  7. Paying, renewing, and cancelling / 결제·갱신·해지

    Every purchase is an Apple In-App Purchase. Apple is the merchant. We never see or store your card details.

    Signing in with Apple is required before you can buy anything. A purchase has to attach to an account, or there is nothing for the entitlement to live on.

    • Payment is charged to your Apple ID account when you confirm the purchase.
    • A subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the current period ends.
    • You manage and cancel subscriptions in your Apple ID settings, not in Seoulvivor. We cannot cancel a subscription for you.
    • Prices and taxes are set per App Store region and may differ from the figures you see quoted elsewhere. Prices may change; Apple notifies you and lets you cancel in the way Apple's own rules require.
    • Cancelling stops future renewals. Your access continues until the end of the period you have already paid for.
  8. Refunds / 환불

    Because Apple is the merchant, Apple handles refunds — we have no ability to issue one for an App Store purchase. Refund requests go to Apple, through "Report a Problem" or your Apple ID purchase history.

    Quest keys are consumables. They are delivered immediately and, once used to unlock a scenario, are generally not refundable — except where Apple's own policy grants a refund, or where mandatory consumer law gives you a right to withdraw or be refunded.

    Nothing in this clause limits rights you have under mandatory consumer law. Depending on where you live that may include, for example, the Republic of Korea's Act on Consumer Protection in Electronic Commerce (전자상거래법), or statutory withdrawal and refund rights in the EU and UK. Where such a right applies, it applies regardless of what this page says.

    Deleting your Seoulvivor account does not cancel an active Apple subscription. Cancel that separately.

  9. Your account / 계정

    Signing in with Apple is required before any purchase, and it is what carries your progress and entitlements between devices. Keep your account secure; you are responsible for what happens on it. Tell us promptly at the address in clause 18 if you think it has been used without your permission.

    You can delete your account from inside the app, and doing so removes your data from our servers. It is irreversible: progress, records, and unlocked scenarios go with it, and buying again does not bring them back. As above, deletion does not cancel an Apple subscription.

    What we collect and how we handle it is set out in the Privacy Policy.

  10. How you must behave / 이용자의 의무

    Your name and your results can be visible to other players on the leaderboard. So:

    • Do not use the leaderboard, a display name, or any other visible field to harass, abuse, threaten, impersonate, or defame anyone, or to post hateful, sexual, or unlawful content.
    • Do not try to bypass entitlement checks, quota limits, paywalls, or our server's record of what you have bought — including by tampering with the app, intercepting or altering its network traffic, replaying receipts, or faking purchases.
    • Do not manipulate the leaderboard or scores by any means other than actually playing.
    • Do not record other people without their consent, and do not submit content you have no right to submit.
    • Do not attack, overload, or probe our infrastructure, and do not evade rate limits.
  11. Who owns what / 권리의 귀속

    Ours. The app and everything in it — the code, the 126 scenarios and the tutorial, the characters and their written dialogue, the prompts and system instructions behind them, the grading rubric, the score card design, the artwork, and the name "Seoulvivor" and its logo — belong to the operator or its licensors. Nothing here transfers ownership of any of it. You get the licence in clause 3 and nothing beyond it.

    Yours. Your recordings and the transcripts of them are yours. We do not claim ownership of your voice or your speech. You grant us only a limited, worldwide, royalty-free licence to record, store, transmit, transcribe, and analyse your audio and transcripts for the sole purposes of running your session, producing your grade and score card, and generating any export you ask for. That licence exists to make the app work and for nothing else. It lasts only as long as those purposes require and ends when you delete your account — except for anything you have separately opted into, which the Privacy Policy governs, and anything we are required by law to retain.

    What you export. You can export and share images, a PDF report, and a video clip generated from your own play session. Those are yours to share as generated. The operator's marks, artwork, and templates inside them remain the operator's, and clause 5 still applies: do not present an export as an official assessment, a qualification, or a TOPIK result.

  12. Availability, changes, and no warranty / 서비스 제공 및 무보증

    The app is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind — express, implied, or statutory — including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the app will meet your requirements or improve your Korean.

    We do not promise uninterrupted or error-free operation. The app depends on Apple, on cloud infrastructure, on RevenueCat, and on your network; outages and maintenance happen, and sessions can fail mid-play.

    We may change, add, suspend, or withdraw scenarios, features, grading behaviour, or tiers at any time, including for reasons of cost, licensing, or model availability. If we permanently withdraw something central to a subscription you are paying for, you can cancel through Apple, and clause 8 governs any refund.

    Some countries do not allow the exclusion of certain warranties. Where that is so, the exclusions above do not apply to you, and our warranties are limited to the shortest period and narrowest scope the law permits.

  13. Limitation of liability / 책임의 제한

    First, what we do not attempt to exclude. Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any other liability that mandatory law where you live — including Korean consumer protection law — does not permit us to exclude. Where such law applies, it overrides everything in the rest of this clause.

    Subject to that, and to the fullest extent permitted by law:

    • we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost progress, or lost opportunity, arising out of or connected with the app;
    • our total aggregate liability for all claims arising out of or connected with these terms or the app is limited to the total amount you actually paid for Seoulvivor in the twelve (12) months immediately before the event giving rise to the claim; and
    • if you paid nothing in that period, that cap is zero, except where the law does not permit such a limit.

    These limits apply whatever the legal theory — contract, tort, negligence, strict liability, statute, or otherwise — and apply even if we were told the loss was possible. They are a deliberate allocation of risk between us, and they are part of the basis on which the app is offered at the price it is.

  14. Suspension and termination / 이용 제한 및 해지

    You can end this agreement at any time: delete your account in the app, and cancel any subscription through Apple.

    We may suspend or terminate your access if you materially breach these terms — clause 10 in particular — or where we are required to by law, or where it is necessary to protect the service or other users. We will give notice where it is practicable to do so. Where the breach is serious, such as fraud, attacks on the service, or tampering with entitlement checks, we may act immediately and without notice.

    If you believe a suspension was a mistake, write to us at the address in clause 18 and we will review it.

    On termination your licence ends and you must stop using the app. Unused entitlements — remaining daily plays, unlocked scenarios, unexpired subscription time — may be lost, and where we terminate for your breach we are not obliged to refund them, except where mandatory consumer law says otherwise.

    What survives. Clauses 4 (AI disclaimer), 5 (non-affiliation), 11 (ownership), 12 (no warranty), 13 (limitation of liability), 16 (governing law), this sentence, and any other provision that by its nature is meant to outlast the agreement, all survive termination.

  15. Apple's role / Apple의 지위

    This agreement is between you and the operator only. Apple is not a party to it and is not responsible for the app or its content.

    • Apple has no obligation to furnish maintenance or support for the app. Support requests go to us, at the address in clause 18.
    • If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
    • Apple is not responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
    • Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the app infringes intellectual property rights.
    • You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
    • Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.
  16. Governing law and venue / 준거법 및 관할

    These terms, and any dispute or claim arising out of or in connection with them or the app, are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

    If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside, and nothing here prevents you from bringing proceedings in the courts of your own country where mandatory law gives you that right.

    Venue is not fixed to a single court by these terms. Subject to the consumer protection immediately above, jurisdiction is determined by the Civil Procedure Act of the Republic of Korea / 관할 법원은 대한민국 민사소송법에 따릅니다.

  17. Changes to these terms / 약관의 변경

    We may update these terms. Where a change materially reduces your rights or increases your obligations, we will give reasonable notice — in the app, or by the email address on your account — before it takes effect.

    Continuing to use the app after the effective date means you accept the updated terms. If you do not accept them, stop using the app and delete your account, and cancel any subscription through Apple. The "last updated" date at the top of this page always identifies the version in force.

    Published under article 10 of the Republic of Korea's Act on Consumer Protection in Electronic Commerce / 전자상거래 등에서의 소비자보호에 관한 법률. Purchases in the app are sold and billed by Apple, not by the operator; see clause 8.

    Odds and ends. If any part of these terms is found unenforceable, the rest stays in force and that part is narrowed to the minimum extent needed to make it enforceable. Our not enforcing something is not a waiver of it. You may not assign this agreement; we may assign it as part of a transfer of the business, on notice to you. These terms, together with the Privacy Policy, are the entire agreement between us about the app.
